العلل المنصوصة في آيات الأحكام وآثارها الفقهية
الملخص
This study aimed to identify the explicit reasons in certain verses of legal rulings, specifically those in Surah Al-Baqarah, Al-Ma'idah, and Al-Hashr. It sought to extract these explicit reasons and explain their jurisprudential implications according to the scholars of the various schools of Islamic jurisprudence. The study included:
Defining the concept of an "explanation" and related terminology, explaining its categories, outlining the fundamental principles for deriving legal rulings, and examining the methods of reasoning in the Quran. The study also focused on practical examples of the explicit reasons in the verses of legal rulings and their jurisprudential implications. The study employed an inductive-deductive methodology and successfully extracted the explicit reasons and clarified their jurisprudential implications. It concluded that understanding the underlying reason is of paramount importance due to its connection to analogical reasoning (qiyas), a source of Islamic law. Furthermore, the study highlighted the importance of understanding the verses of legal rulings, as they clarify and indicate legal rulings, either explicitly or through deduction.
