الملخص

The study aimed at manifesting the fundamental rules related to discordance
and weighing opinion from narration adopted by the diligent to extract Sharia rules
related to the deeds of religiously charged and weighing opinion between different
and contradictory doctrinal sayings on its surface, and to realize some of the
jurisprudential branches prescribed on it. The study followed the analytical
inductive method. The study found that the weighing opinion among evidence is
the last tip for the diligent before the legislative rules are applied to the religiously
charged, and that the weighing opinion depends on the legislative evidence and its
related matters in terms of proving its significance and strength, and that it is not
permissible to contradict the legislative evidence in a way that could not be refused
by the diligent scientists
